Application for rehearing may be filed within the delay allowed by art. 922, La. C.Cr.P. A jury convicted James Tildon Harrison, Sr. (""Harrison""), as charged, with distribution of cocaine, La. R.S. 40:967. 1 After his subsequent adjudication as a third felony habitual offender, La. R.S. 15:529.1, the trial Judge sentenced him to life imprisonment without benefit of parole, probation or suspension of sentence. Harrison now appeals, urging eight assignments of error. We affirm the conviction, vacate the enhanced sentence and remand to the trial court for resentencing in accordance with this opinion.
